Skully Peterson is a student at University. He is a big college basketball fan and bet his life savings on the team winning the Tournament. Unfortunately for Skully the team lost and he lost his life savings. Skully turns to a life of crime survive and starts stealing cars in and around the city. One night he goes to steal a car when the owner jumps out punches Skully in the face. Skully then pulls a gun and shoots the car owner, killing him. Skully is arrested by the Police Department and charged with murder. The car owner’s family also files a wrongful death lawsuit against Skully.
The Judge in Skully’s case is Paul Easter. He was appointed as a judge approximately 30 years ago and has been on the bench ever since. He has recently been accused of accepting bribes by defense attorneys in exchange for imposing lesser sentences on their clients. Judge Easter thinks that he knows Skully’s family, he isn’t certain but he thinks that Skully lived down the block from him and may have even dated one of his daughters.
Since Skully lost all his money gambling he can not afford an attorney. The detectives that question Skully about the murder bring him to headquarters and read him his Miranda rights. He indicates that he would like an attorney but can not afford one. The detectives respond that the state will provide him an attorney. Skully says that he doesn’t understand how that is possible, someone will have to pay the attorney’s salary and he doesn’t want to be on the hook for repayment. After several minutes of going back and forth on this issue one of the detectives slaps Skully in the face screaming “What’s the matter with you! It’s free free free!” The smack seems to work and Skully realizes what is going on and indicates that he does want an attorney. The detectives immediately stopping questioning Skully and allow him to consult with an attorney.

state judges. After listing and discussing the various arguments please tell whether

3. Please discuss the evolution of the right to counsel from beginning from the British
law through today. Please refer to the facts and the names of the cases which helped
to change the law. Do you think that attorneys are actually necessary in criminal cases? Why or why not? Do you think that attorneys should be free in criminal cases or do you think that the accused should receive a bill after the case, perhaps at a discounted rate?
